Los profesionales del seguro: Los abogados y procuradores. Los juicios y la justicia.
Cuando tu seguro no acepta una reconsideración por una valoración de un siniestro que has sufrido, el siguiente paso sera hacer una reclamación judicial para que sea el juez quien decida quien tiene la razón. Entre abogados, procuradores, jueces y procedimientos, puedes hacerte un lío, así que a continuación te contamos en qué consiste cada cosa.
El pasado martes acudí a un juicio por primera vez en mi vida. Estaba muy nervioso. Me citaron como testimonio de un accidente que ocurrió en una gasolinera. El juicio iba que el afectado demandaba al seguro de la estación de servicio, y a la misma empresa petrolera, por unos daños que él mismo se ocasionó en la ropa y los zapatos manchándose con gasóleo en el momento de dispensarse el carburante. Se ve que tanto los zapatos como el traje valían 3.500 €. Eran de no sé qué marcas italianas que no había oído hablar en mi vida. ¡Estos pijos están forrados! No me extraña, ya que el hombre iba con un Porsche Panamera impresionante. Yo creía que la culpa es de la misma persona que se dispensa el carburante pero resulta que tanto el perito como el abogado del afectado basaban la reclamación en que los usuarios no tenemos formación ni es nuestra obligación dispensarnos carburante. Además estamos manipulando mercancías peligrosas. Y ¿cómo puede ser que la administración regule, controle y sancione a empresas cuyas actividades tienen mucho menos peligro que una gasolinera, como sería el caso de una zapatería, y una actividad como es dispensar mercancías peligrosas, tanto por la emanación de vapores tóxicos como porque se trata de productos inflamables, no deba ser personal especializado quien deba dispensarlo? La verdad es que me hizo reflexionar sobre cómo puede ser que la administración sea tan irresponsable de permitir que existan gasolineras sin personal, donde si pasa una desgracia allí no hay nadie, y cómo puede ser que uno mismo se pueda dispensar el carburante sin tener ni idea de qué debe hacer en caso de cualquier contingencia con un pobre empleado cobrando a los clientes con auténticas colas quilométricas.
La verdad es que cuando entré al juicio creí que era una reclamación perdida. Cabe decir que el abogado de la defensa no me gustó nada, pero el perito y el abogado de la parte demandante eran unos fenómenos. Me pareció asistir a un partido del Barça o el Madrid contra el “Roquetas de Mar”. Allí me di cuenta de lo importante que es tener a buenos peritos y abogados que te lleven el asunto. No se cómo acabó el juicio pero mi veredicto hubiera sido condenar al seguro de la gasolinera.
¿Qué es la justicia y qué es el derecho?
Lo primero que debemos entender es qué diferencia existe entre el derecho y la justicia. El Derecho es un conjunto de normas y ordenaciones que sirven para regular las relaciones humanas de una sociedad y cuya observancia puede ser impuesta de manera coactiva. La Justicia es un concepto moral amplio donde el derecho tiene como finalidad última hacerla posible. ¿Es justo que un violador de una menor sólo cumpla una condena efectiva de 3 años de cárcel? Seguramente todos diremos que “no es justo”, pero el derecho lo establece así.
Los tribunales de justicia ¡NO HACEN JUSTICIA! ¡APLICAN EL DERECHO! Aplican las leyes y resto de normas del ordenamiento jurídico, pero no hacen justicia. Intentan hacer justicia aplicando el derecho pero insistimos, el objetivo del derecho es hacer justicia, pero no es lo mismo. A muchas personas les interesa confundir a las gentes mezclando estos conceptos, pero esperamos que la diferencia haya quedado clara.
¿De dónde sale el derecho?
Y las normas (Derecho) las hacen o “fabrican” los políticos, que son esas personas que escogemos de manera “democrática” para que nos representen en los correspondientes Parlamentos. Y todos consideramos que esas normas deberían estar al servicio de la gente, pero en numerosas ocasiones pensamos que sólo están para proteger a los poderosos y privilegiados ya que algunos políticos tienen relaciones muy estrechas con los grandes poderes. Decimos esto ya que muchas veces, ni nosotros mismos, acabamos de entender según qué normas.
¿Qué es un juez?
El juez es aquella persona que tiene la potestad de valorar una disputa entre varias partes en base a una serie de hechos probados y sentenciar, de acuerdo con el derecho, intentando hacer justicia. Pero atención, su obligación es aplicar el derecho aunque considere que las normas sean totalmente injustas.
¿Qué es un abogado?
Un abogado es un profesional que tiene la titulación universitaria en derecho y la posterior titulación en abogacía, y que ejerce la representación jurídica de una de las partes del juicio. Por tanto el abogado ayuda a las personas a acceder al ámbito judicial y a defender los intereses de su cliente ante los tribunales.
A los abogados no les importa la justicia ni si su cliente tiene razón. Su misión no es hacer justicia ni aplicar el derecho, que eso es competencia del juez. Su misión es, en base al derecho, intentar defender los intereses de su cliente hasta lo que el propio derecho le permita. Nada más. La misión de aplicar el derecho intentando impartir justicia es del juez, no del abogado.
Por tanto, en muchas ocasiones no entendemos el porqué los abogados hacen determinadas cosas que vemos injustas, como sería defender a un asesino reincidente o a un terrorista. Pero su misión no es hacer justicia ni aplicar el derecho. Como ya hemos dicho, su misión es representar y defender los intereses de su cliente, independientemente de los actos que haya cometido. Nada más.
¿Qué es un procurador?
Un procurador de tribunales es otro profesional que tiene la titulación universitaria de derecho que representa de manera exclusiva a su cliente ante los tribunales. Colabora con los tribunales haciendo los trámites procesales con su representado como son trasladar notificaciones, requerimientos, etcétera. La verdad es que, con los avances tecnológicos actuales, los procuradores son una figura cada vez más prescindible y que sólo se sustenta porque las leyes obligan a tenerlo, pero el valor que aportan a un procedimiento es cada vez menor.
Tipos de tribunales. Los tribunales de Primera Instancia.
Según el tipo de conflicto que haya entre dos partes, y éstas no hayan llegado a un acuerdo, los ciudadanos podemos acudir a una institución llamada tribunal, donde habrá un juez que resolverá el conflicto aplicando el derecho con el objetivo de hacer justicia. Pero en España, como en otros países, existen varios tipos de tribunales segmentados por “especialidades” con el objeto de aplicar mejor el derecho. Si se trata de un conflicto con una administración, por ejemplo un ayuntamiento, deberé acudir a un tribunal “contencioso-administrativo”. Si se trata de un asunto mercantil deberé acudir a un “juzgado mercantil”. Lo mismo para un delito donde deberé acudir a un “juzgado de instrucción”. Y así con los juzgados sociales, de primera instancia, etcétera.
En el caso particular de los seguros, que es el objeto de este post, los tribunales a los que acudimos en caso de conflictos con una aseguradora o conflicto entre ellas es a los tribunales que resuelven conflictos de ámbito civil, que son los de “Primera Instancia”. Dado el caso que la resolución del juez no se adecúe a Derecho, podremos acudir a instancias superiores para que corrijan el error. En el ámbito de los seguros, en ocasiones debemos recurrir a otro tipo de tribunales como los de instrucción, pero eso son casos son muy residuales y no lo trataremos para no alargar.
Tipos de procedimientos judiciales en el ámbito civil
Todo esto viene regulado en la Ley 1/2000 de Enjuiciamiento Civil. Muy a grandes rasgos, los procedimientos dependen de la cuantía económica que esté en litigio. Para ello tenemos dos tipos de juicios: Los procedimientos verbales y los procedimientos ordinarios.
El procedimiento verbal
Un juicio verbal es aquel donde la cuantía en litigio es inferior a 6.000 €, donde el demandante entra su escrito en el “decanato del juzgado” y a partir de allí se reparte y se traslada a la parte contraria. El demandado tiene 10 días para contestar y solicitar la celebración de la vista (=juicio) para que luego se produzca la sentencia. En la vista se presentará el juez, secretario, los abogados y procuradores de las partes, los peritos, los testigos y los implicados o litigantes.
Si el importe de la disputa es inferior a 2.000 €, las partes pueden acudir sin representación, o sea, sin abogado ni procurador.
Cabe destacar que si la cuantía de un asunto es inferior a 3.000 €, en caso de ser desfavorable a nuestros intereses, no habrá derecho a presentar un recurso para que un tribunal de instancia superior (Audiencia Provincial) lo corrija. Deberemos resignarnos con la “injusticia”.
Procedimiento ordinario
Un juicio ordinario es aquel cuya cuantía supera los 6.000 € hasta el “infinito”. A diferencia del verbal, las partes tienen que ir representadas por abogado y procurador. Una vez interpuesta la demanda, el o los demandados tienen 20 días para contestarla y aportar todas las pruebas que sean oportunas.
Antes de la vista o juicio, los abogados celebran una “audiencia previa” con el juez, donde se concretan los hechos de controversia. De este modo se saca mucha la “paja” y se concreta el “grano” sobre el que debe tratarse el asunto. Allí se decide si se celebra el juicio, se proponen los testigos y los peritos que deben acudir. También se decide el día de la vista (=juicio).
Tras el juicio, el juez se pronuncia con una sentencia o fallo. El juez puede condenar en costas a una parte si resulta que le da absolutamente toda la razón a la otra parte. O sea, el que pierde todo “el partido” lo paga todo.
¿Qué es un juicio o una vista?
El juicio es un acto donde se pone en conocimiento del tribunal todas las causas en las cuales en juez ha de pronunciar su sentencia. Habitualmente se celebra en una sala habilitada para tal fin (sala de vistas).
¿Cuánto vale un abogado?
Los honorarios de los abogados son libres y pueden cobrar lo que quieran, igual que el resto de la gente. Los colegios profesionales publican unos honorarios orientativos, que aunque no sea obligatorio seguirlos, sirven de guía para muchas tasaciones de costas. A modo de ejemplo y como muy escueto, reflejamos una tabla de un colegio profesional donde se fijan los honorarios de los abogados para asuntos civiles como los que nos ocupan. Los honorarios de uno u otro colegio pueden diferir sensiblemente, pero todos son más o menos en la misma línea.

Con respecto a estos honorarios, si el cliente decide recurrir la sentencia de primera instancia, el abogado cobrará, además de lo que ya ha cobrado, los mismos honorarios que en primera instancia pero reducidos en un 50%. Esto significa que, en un tema donde se ha sentenciado en primera instancia y se recurre en una segunda instancia, el cliente finalmente pagará los honorarios de la tabla multiplicados por un coeficiente de 1,5.
¿Cuánto vale un procurador?
A los honorarios de los procuradores se les llama “aranceles”. El arancel del procurador viene recogido en el Real Decreto 1373/2003 por el que se aprueba el arancel de derechos de los procuradores de tribunales. A grandes rasgos siguen la siguiente tabla:

Comentario final
Los abogados tienen una función muy concreta y deben utilizarse para cuando el asunto lo requiere. En el resto de ocasiones no serán necesarios.
En todas las ocasiones el usuario puede reclamar los daños sufridos a la aseguradora, ya sea propia o del tercero “culpable”. Sobre todo cuando se trata de temas sencillos. Cuando se trata de temas más complejos lo más adecuado es acudir a peritos, quienes efectuarán sus informes periciales y el usuario podrá reclamar el asunto por vía extrajudicial. Sólo en última instancia, y en caso de ser estrictamente necesario, será el momento de acudir a un abogado para efectuar la reclamación para que sea un juez quien, en aplicación del derecho, intente hacer la justicia que todos deseamos.
