Qué cubre el seguro de coche novel

¿Eres joven y no sabes cuando estás cubierto por el seguro del vehículo, aunque no estés declarado en la póliza, y cuando no lo estás? Hoy hablamos de los seguros para jóvenes y qué pasa cuando estos no están declarados en la póliza.

El seguro siempre cubre a terceros

Primero de todo debes tener en cuenta que si el vehículo tiene seguro, este cubre los daños ocasionados tanto si lo conduces tú como otra persona, cumpla o no el perfil del contratante. La aseguradora deberá pagar siempre todos los daños a los afectados. Ahora bien, la compañía de seguros solo te podrá reclamar lo que haya pagado a los damnificados en estas tres situaciones (art. 10 de la Ley sobre responsabilidad civil y seguro en la circulación de vehículos a motor):

  1. Que hayas querido atropellar a alguien expresamente para matarlo o herirlo
  2. Que vayas bajo la influencia de bebidas alcohólicas o drogas u otros estupefacientes o sustancias psicotrópicas
  3. Que no estuvieras en posesión de la licencia de conducción (que aun no te lo hayas sacado o te lo hayan retirado temporalmente por puntos o algo así).

Cláusulas que están cubiertas o no según la edad

A parte de las coberturas obligatorias del seguro, los daños a terceros, hay otras coberturas que se pueden contratar como son el robo, incendio, daños propios, etc. ¿En cuáles afecta tu edad al precio que vas a pagar y en cuáles no?

Coberturas que no les afecta tu edad

Incendio, lunas y robo. Con esas puedes estar tranquilo, ya que habitualmente cuando sucede el accidente el vehículo está parado sin conductor. La aseguradora lo pagará todo aunque no estés declarado. Son unas coberturas que no dependen de quienes conduzcan, sean noveles, jóvenes o expertos.

Coberturas donde sí afecta tu perfil de novel
  1. Daños propios. A excepción de los actos de vandalismo, en esta sí que te van a meter problemas. Esta cobertura consiste en pagar los daños causados a tu vehículo por tu culpa mientras tú conduces.
  2. Seguro de vida y accidentes para el conductor. En esta también tendrás problemas. Consiste en pagar indemnización por lesiones que tengas tú, incluso tu muerte, cuando tú conduces.
  3. RC Voluntaria. En esta por supuesto que también tendrás problemas. Consiste en pagar aquellos daños que hayas ocasionado por tu responsabilidad civil como conductor que no queden cubiertos por el SOA regulado por la LRCSCVM, que son poquísimos casos.
  4. Asistencia (en carretera y viaje). También tendrás problemas en que te vengan a buscar si te quedas tirado o has tenido una colisión donde el conductor seas tú. O sea, que te tocará pagar la grúa entre otras cosas.
  5. Defensa jurídica y declamación de daños, o también denominada protección jurídica. Pues en esta también es muy posible que la aseguradora no quiera pagarte los gastos de peritos y abogados en caso que seas perjudicado en un accidente de circulación y debas reclamar tus daños, perjuicios y/o lesiones.

En caso que no te hayan declarado y no hayáis pagado el incremento de precio correspondiente pueden darse dos opciones: o no te cubrirán esas garantías afectadas por tu perfil de conductor o bien os aplicarán un descuento descomunal denominado “regla de equidad”. Si el seguro no te quiere pagar alguna de estas coberturas contacta con nosotros y miraremos qué podemos reclamar para que recibas lo que justamente te corresponde.

Si la culpa del accidente la tiene otro conductor

Si la culpa del accidente la tiene el contrario, ¿qué te pasará con tu seguro de coche novel? ¿qué te cubre? ¿qué puedes reclamar?

La aseguradora contraria lo deberá pagar todo independientemente de tus condiciones con el seguro de tu vehículo. Puedes reclamar todos los daños, perjuicios, lesiones, pérdidas patrimoniales, pérdida de ingresos, gastos médicos, el móvil, ipad, chaqueta y todo los que puedas probar y acreditar.

Aquí no pinta nada tu seguro. Pero aunque tu seguro no te pague ni la grúa guarda el recibo. La aseguradora contraria te lo deberá reembolsar. Y como tu aseguradora te dejará colgado, contacta con nosotros. El seguro te pagará hasta nuestros gastos ya que se tratará de un “daño emergente” que es una palabreja muy antipática que ya te comentaremos qué es en otro post.

Otras consideraciones importantes a tener en cuenta

Además de lo que hemos comentado, recuerda tener en cuenta estas tres cosas importantes:

  1. Si el coche no tuviera seguro ¿Qué te pasaría? Mal. El Consorcio de Compensación de Seguros pagará los daños al perjudicado y luego te reclamará todo lo que haya pagado y deberás acogerte a la Ley de la Segunda oportunidad porque te arruinarán “de saque” y jovencito.
  2. Atención con los «nuevos» seguros de StartUps. Muchos no son lo que parece y son un timo. Crees que tienes aseguradas unas cosas y no es así. No te dejes engañar.
  3. Piensa que hay algunas aseguradoras, ni mucho menos todas, que engañan a la gente sin escrúpulos. Finalmente piensa que en ClaimCenter está para «salvarte». Contacta con nosotros ante cualquier problema que tengas tú o cualquier familiar, amigo o conocido.
