¿Qué cubre y para qué sirve el Consorcio de Compensación de Seguros (CCS)?
No entraremos a explicar de manera extensa y detallada cuáles son las funciones del Consorcio de Compensación de Seguros (CCS) y para qué sirve, ya que necesitaríamos una “Wikipedia”. Pero lo que haremos de manera muy genérica es explicar cómo nos afecta a los usuarios, en los casos más frecuentes, a la hora de cobrar accidentes que se han producido en unas circunstancias muy concretas.
¿Qué es el Consorcio de Compensación de Seguros?
El Consorcio de Compensación de Seguros es una “entidad de derecho público con personalidad jurídica propia”. Esta frase viene a decir que es una “aseguradora privada” que pertenece al Estado español pero que tiene unas funciones muy concretas que las Leyes españolas le confieren. Algunas de sus actividades son la de liquidadora de aseguradoras, la cobertura de riesgos extraordinarios, la de Fichero Informático de Vehículos Asegurados (FIVA) y un largo etcétera de funciones.
La actividad del Consorcio de Compensación de Seguros
El CCS se creó para dar respuesta a dos necesidades básicas:
- La propia actividad aseguradora, es decir, asegurar los riesgos o accidentes de carácter extraordinario.
- La actividad de “fondo de garantía”.
Una cosa a tener en cuenta es que el Consorcio de Compensación de Seguros no está para “ganar dinero” como sería el caso de una aseguradora “normal”. El CCS sólo está para dar servicio al ciudadano, y por lo tanto, su actitud es muy distinta a la de muchas aseguradoras comerciales convencionales.
Actividad aseguradora. Lo que paga el Consorcio de Compensación de Seguros de riesgos extraordinarios
Todas las personas que tenemos un seguro de daños propios del vehículo, o sea, un seguro de coche a todo riesgo (cubrimos nuestros daños al vehículo además de los daños a los perjudicados), un seguro de vida, de accidentes, del hogar, de comercio, de comunidades, de empresas,…, pagamos una pequeña parte del precio al Consorcio de Compensación de Seguros. De este modo, cuando aseguramos nuestros bienes o nuestra persona estamos asegurados con dos seguros a la vez. Uno es nuestro seguro “normal” (SegurCaixa, MGS, MAPFRE,…) y el otro es el CCS.
Esto se hace porque las aseguradoras “normales” no pagan los accidentes derivados de daños materiales, personales o lucro cesante (pérdida de beneficios) cuando las circunstancias del accidente son inundaciones, terrorismo, tempestad ciclónica atípica u otros riesgos recogidos en el “reglamento de seguro de riesgos extraordinarios”, y por tanto, eso lo paga el CCS.
Otra cosa que el Consorcio de Compensación de Seguros paga son los “daños a terceros” cuando el ejército español o la policía, sea autonómica o estatal, en tiempos de paz, hace daño a alguien. Sería el caso que la Guardia Civil nos colisiona por detrás con el coche o que un soldado despistado, haciendo maniobras, nos destruye nuestra casa de un “bombazo” propinado por un tanque. Pero atención, ésto lo cubre el Consorcio de Compensación de Seguros siempre y cuando tengamos contratado un seguro de daños propios. El tema de la «responsabilidad civil» de la policía o el ejercito se llama «responsabilidad patrimonial de la administración» y eso lo pagan seguros especiales que cubren este tipo de daños a los que destinaremos unos cuantos posts.
El CCS jamás paga accidentes derivados de la responsabilidad civil de las personas. Eso lo paga cada aseguradora, y si uno no tiene seguro, lo deberá pagar de su bolsillo.
Nota final: No podemos asegurarnos directamente con el Consorcio de Compensación de Seguros. No es una aseguradora comercial “normal”. Ahora bien, si no hay ninguna aseguradora “normal” que quiera asegurarnos un seguro obligatorio, como es el caso del SOA en motos o coches de conductores noveles, puedes contratar tranquilamente ese seguro con el Consorcio de Compensación de Seguros.
Actividad de “fondo de garantía”
Pero hay situaciones donde los ciudadanos estamos desprotegidos y el Consorcio de Compensación de Seguros actúa como “fondo de garantía”, para pagarnos y luego “buscarse la vida” de cómo recobrar eso que nos ha pagado como perjudicados.
Resulta que, cuando un vehículo robado o sin seguro nos causa daños materiales o personales, la aseguradora que se ocupa de indemnizar nuestros daños, lesiones, días de baja y resto de cosas derivadas de la responsabilidad civil del conductor es el CCS, y luego ya reclamará al ladrón, si lo encuentra, o al que iba con el coche sin el SOA.
Otro caso donde el Consorcio de Compensación de Seguros paga las lesiones a los perjudicados en accidentes de tráfico es cuando el causante del accidente se da a la fuga y, por tanto, es desconocido.
Otra de las situaciones donde el CCS actúa como fondo de garantía es cuando se hace cargo de todos esos siniestros en curso pendientes de indemnizar cuando una aseguradora de las “normales” se va a la quiebra.
¿Cuándo debemos dar parte al Consorcio de Compensación de Seguros?

Hola buenos días hace unos 4 meses me dieron un golpe estando el coche aparcado en zona azul y el vehículo se dio a la fuga sin dejarme datos tengo testigos y la matrícula del vehículo pero su compañía no quiere hacerse cargo lo niega ….q puedo hacer ? Aquí estaría cubierto los daños por el consorcio ? Gracias
Hola, si no hay atestado o DAA firmada reconociendo culpa, no puedes reclamar al CCS. Tu compañía puede estudiar la viabilidad de la reclamación con los testigos. Un saludo, Eva

Tengo una duda. Si en el seguro de hogar que contrato (uno básico), en el desglose de la prima total, aparece la cantidad de 0,00€ para el Consorcio, quiere decir que no estaría cubierto por éste ?

Hola, mi hija cogió un vehículo que no tenía ni seguro ni ITV por una urgencia y estando en cola un vehículo le dio por detrás, le dio un ataque de ansiedad y abandono el lugar para ir a urgencias, nosotros nos comunicamos con la policía mientras mi hija esta en urgencias.. La policía nos comenta que no hay ningún atestado de esa hora y cuando vamos a la Guardia Civil a ver.. Había ido el chico directamente para denunciar a mi hija por darse a la fuga, declarando que le invadió el carril para después frenar.. Ocasionando el golpe trasero.. Una vez prestó mi hija declaración y viendo el coche, la Guardia Civil nos comunica que estemos pendientes del correo, porque nos llegará la correspondiente multa, que era el propio seguro del otro coche quien tendría que denunciar, al ellos no haber Estado presente no iban a presentar denuncia.. Y hoy nos llega una carta del Consorcio para prestar declaración.. Me podría explicar si yo puedo reclamarle también los daños al haber sido el quien le dio a mi hija por medio de ustedes? Porque auque el echo de darse a la fuga quedo probado, al no tener seguro no se como actuar! Muchas gracias!

Si tienes un seguro de incendio que cubre tus bienes será ese seguro. Si hay identificado un culpable será ese culpable, y tu seguro de Protección Jurídica o también denominado Defensa Jurídica y Reclamación de Daños de tu seguro del hogar será el que costeará los honorarios de los profesionales para realizar la reclamación a ese culpable hasta el límite de la suma asegurada que fije tu contrato.
A causa de las fuertes lluvias mi coche mientras circulaba por via de servicio se quedo parado en un charco sin senyalizar, el coche entro agua en el motor y esta ya en el desguace destruido ya que el perito dijo que el costabamas los daños que pagarlo arreglo matricula, lo taso en 2000 euros el consorcio me ha denegado la indemnizacion por que dicen que no son causas extraordinarias a un amigo cuando se lo conte me dijo que le habia pasado lo mismo en el mismo lugar y si le pagaron. Mi aseguradora Allianz indica que contra el estado es inviable ayudarme judicialmente, que puedo hacer?
Hay que ver cuánta lluvia cayó ese día en esa zona, su contrato de seguro del vehículo y estudiar el tema. Saludos
Tuvimos un terremoto y ice seguro ese día a los tres días hubo otros dos de magnitudes más grandes ,llamar a consorcio vino un perito y a los días me mandaron correo donde ponían que no se hacían cargo. Y la casa está muy afectado que puedo hacer
El Consorcio de Compensación de Seguros no cubre los daños si se encuentra dentro del periodo de carencia de 7 días naturales, desde la fecha de efecto de la póliza hasta la fecha del siniestro. Por eso no se lo pagan. Está recogido en el Reglamento de Riesgos Extraordinarios.
Lo que debe hacer es buscar otra póliza (comunitaria), si se trata de un piso, que cubra esos daños.
Solo quedaría cubierto si la nueva póliza fuera un reemplazo de otra antigua y no se hubiera suspendido la cobertura.

Hola hace casi un ano cayo de un edificio una canal encima de mi coche y no quieren pagar los danos. El geguro edificio no tiene rc aterceros . Que puedo hacer.
Puede usted utilizar la garantía de Reclamación de Daños de su vehículo para reclamar sus daños a la comunidad de propietarios.
Es muy extraño que una comunidad de propietarios tenga un seguro y no disponga de la garantía de responsabilidad civil. O no tiene seguro o si lo tiene tiene tanto la garantía de daños propios como la de responsabilidad civil.
Buenos días. El pasado 27 de Enero, mis hijos y yo tuvimos un grave accidente de coche en Mallorca, en la autopista que va a Palma. Salió en las notícias de toda España. Fue el caso de la suicida que al lanzarse del puente provocó un desastre. El cuerpo quedó en medio de la carretera y no pude esquivarlo por lo que tras el volantazo para evitar un choque en cadena dimos vueltas de campana u el coche quedó a un lado de la carretera, gracias a Dios. Mis hijos no se hicieron nada grave pero yo tuve que ingresar unos dias por una gran brecha en la frente y dolores espantosos. El coche siniestro total. Tengo que hacer rehabilitación de por vida ya que sufrí una discopatia que me provoca un dolor que se irradia desde cervicales hasta brazos y hombros. El Abogado del seguro investigó a la suicida y parece ser que no tenía nada la pobre mujer. Mi seguro no era a todo riesgo, tengo que apuntar.Mi pregunta es si el Consorcio indemniza en nuestro caso. Es un caso muy raro y no he leído que no esté fuera de cobertura. Muchas Gracias por su tiempo. Espero que puedan darnos una respuesta.

Hola buenas tardes, me gustaría que me aclararán un suceso que pasó en diciembre del año 2019, pues bien, varios contenedores de la basura a causa del fuerte viento que hizo ese día en el que causó daños a varios coches entre ellos el mío, mi aseguradora me dice que los meses de diciembre y enero todavía no lo a publicado el consorcio en su web. Deberíamos estudiar su contrato de seguro, pero sus daños pueden estar cubiertos por la garantía de daños propios si la tiene contratada.
El Consorcio de Compensación de Seguros (CCS – http://www.consorseguros.es) podría hacerse cargo de los daños si considera zona afectada por vientos extraordinarios.
Por tanto debe mirarse la fecha del siniestro, el lugar donde se produjo, las causas, circunstancias y consecuencias del accidente y su contrato.

No estoy muy puesto en este tema pero a mi me pasó una vez y lo trasladé al seguro siendo él quien reclamó al ayuntamiento de la localidad , ya que ellos tenían las competencias del servicio de recogida de basuras .
También en el tema de las alcantarillas , ceras en mal estado , etc, son motivo de reclamaciones de daños directamente hacia él o los ayuntamientos , son ellos quienes tienen que responder con sus seguros.
Por eso entiendo que también podía reclamarlo yo directamente al ayuntamiento .

El seguro de coche me ha dado baja, dice que me han enviado una carta certificada, que nunca recibí xq cambié de dirección. Me ha parado la policía y me han retenido el coche, ahora tengo que pagar un multa de 1500€ por ir sin seguro. Que puedo hacer, no se supone que ellos deberían asegurarse q recibiera la carta, si les envío nuevamente xq no la reenviaron o enviaron un sms, como lo hacen por muchas otras cuestiones.
