Si ya leíste nuestro pasado post acerca de si las empresas pueden cobrar una indemnización por las pérdidas producidas por el Covid-19, en éste te contamos por qué garantía del seguro, que cubre el continente de tu local comercial o industrial como propietario, el Consorcio de Compensación de Seguros debería pagar la indemnización del alquiler que, como propietario, has dejado de percibir del inquilino, ya que éste te lo dejó de pagar por que tuvo que cerrar debido a la declaración del estado de alarma por la pandemia del COVID19.
Escenario
No entraremos en tratar los conceptos jurídicos que ya tratamos en el pasado post. Pero resulta que hay propietarios de locales y establecimientos que los tienen alquilados a inquilinos que desarrollan actividades mercantiles y debido a la declaración del estado de alarma por el riesgo extraordinario de la pandemia del COVID19, esos inquilinos no pudieron abrir sus negocios y muchos dejaron de pagar a los propietarios los correspondientes alquileres.
Atención: esto que exponemos no va dirigido a aquellos locales o viviendas que sí estaba ocupados y se utilizaban y el inquilino dejó de pagar al propietario por la circunstancia que sea. Este post va orientado exclusivamente a locales cuyas actividades mercantiles se vieron forzosamente obligadas a cerrar total o parcialmente por la declaración del estado de alarma debido al COVID19.
Cobertura de pérdida de alquileres
Si sufres un siniestro de incendio o inundación y tienes un local comercial donde el inquilino deja de pagarte el alquiler durante el tiempo que queda inhabitable, ya que se están realizando las tareas de reconstrucción debido al siniestro, la aseguradora ordinaria o el Consorcio de Compensación de Seguros te pagarán, como propietario del local, el alquiler dejado de pagar por el inquilino, por la garantía de pérdida de alquileres.
Pues en el caso que nos ocupa, y por la misma garantía, los alquileres dejados de pagar por el inquilino del local que tuvo que tener cerrado debido a la pandemia del COVID19 y la consecuente declaración del estado de alarma por parte del gobierno, el Consorcio de Compensación de Seguros te deberá pagar esa indemnización ya que pagaste prima por tener esa garantía.
