En otro post ya contamos qué grupos de coberturas cubren los seguros de vehículos. Éstas son la responsabilidad civil, la garantía de defensa jurídica y reclamación de daños, asistencia en carretera, etcétera. Pero en este post nos centraremos en qué cubre la garantía de daños propios o seguro a todo riesgo.
La garantía de seguro a todo riesgo
La Real Academia Española define riesgo como contingencia o proximidad de un daño, o cada una de las contingencias que pueden ser objeto de un contrato de seguro. Y es obvio que una contingencia es la posibilidad de que algo suceda o no suceda. Ese «algo» no designa más que una realidad indeterminada. Por tanto, un seguro a todo riesgo de un vehículo cubre, por extensión, cualquier cosa que le suceda al vehículo de manera accidental e imprevisible, ya sea fruto de una colisión, fallo mecánico, robo, incendio, hurto, actos vandálicos, fenómenos de la naturaleza y un largo etcétera de accidentes que pueden suceder.
Por tanto la delimitación del todo riesgo respecto al bien asegurado, que es el vehículo, implica cubrir cualquier daño que éste sufra en cualquiera de sus componentes debido a cualquier circunstancia que sea objeto, como por ejemplo que se caiga accidentalmente una taza de café en la tapicería.
Cláusulas que limitan los derechos del asegurado
Pero aparte de las cláusulas que delimitan el riesgo, existen las cláusulas que delimitan los derechos del asegurado de las cuales ya destinamos un post, y resulta que éstas deben estar específicamente aceptadas por escrito si la aseguradora las quiere aplicar. Y es obvio que, en los contratos de todo riesgo, habitualmente queda limitado a daños que sufra el vehículo por las siguientes causas:
- Daños como consecuencia de colisiones, accidentes, vuelcos con el vehículo, etcétera.
- Por incendio, explosión o caída de rayo.
- Daños por robo, hurto y/o actos de vandalismo.
- Por fenómenos atmosféricos (granizo, viento, lluvia,…)
- Daños por caída de árboles, postes de líneas eléctricas, desprendimientos de edificios, caída de aeronaves, objetos siderales, etcétera.
- Por hundimiento de carreteras, fenómenos de la naturaleza como erupciones volcánicas, inundaciones, terremotos, embates de mar, etcétera, estos últimos cubiertos por el Consorcio de Compensación de Seguros.
Obviamente no podía faltar la rotura de lunas y cristales por cualquier causa; aunque para gozar de esta última cobertura no hace falta tener el coche con seguro a todo riesgo. Lo puedes tener con la responsabilidad civil más la cobertura de lunas o cristales.
Pero esas mismas cláusulas que limitan los derechos del asegurado excluyen de manera específica, a modo general, lo siguiente
- Averías mecánicas de cualquier índole como serían la falta de aceite del motos, la falta de agua del radiador, etcétera.
- La avería o reparación de neumáticos.
- El desgaste de piezas o falta de conservación y mantenimiento.
- La subsanación de defectos de construcción o reparación del vehículo.
- También excluyen los objetos incluidos en el vehículo, como son los equipajes, objetos personales de los ocupantes, sillas de bebé, etcétera.
