Las inundaciones y otros daños provocados por las lluvias. El CCS y las aseguradoras.
Tengo un pequeño hotel en Sitges (Barcelona). El miércoles 6 de junio de 2018 cayó una tromba de agua impresionante que anegó las calles. El agua entró por la azotea ya que el desagüe no daba abasto para evacuar toda el agua caída, lo que dañó varias habitaciones de la última planta.
El agua que bajaba por la calle era como un río. Entró en el parking y anegó dos coches. Además cometí una imprudencia intentando sacar mi coche a la calle para que no quedara sepultado por el agua, pero el esfuerzo fue inútil. Resulta que la tromba de agua que bajaba por la rampa se me llevó por delante y me hizo caer contra unos bultos fracturándome dos extremidades: la pierna y el brazo.
Mi coche inundado, el hotel con daños por inundación en la planta baja y el parking. El agua que entró por la azotea dañó las habitaciones de las dos últimas plantas. Mi hotel parado en pleno mes de junio perdiendo dinero, ya que tuve que desalojarlo durante un mes para arreglarlo todo. Lo tenía todo asegurado. Un seguro de vida y accidentes, de daños del hotel, de pérdida de beneficios del hotel y uno del coche. Cuando llamé a los seguros decían que debía ir al Consorcio de Compensación de Seguros (CCS). Los peritos del CCS me dijeron que habían daños que me los debían pagar los seguros «normales». En definitiva, todo un lío. Finalmente me recomendaron a ClaimCenter y los contraté para que me llevaran todo el asunto con todos los seguros ya que estaba totalmente perdido. Vi que algunos peritos de las aseguradoras no tenían muy claro todo el asunto. Al menos en ClaimCenter me lo dejaron todo clarísimo y me lo gestionaron a la perfección.
¿Qué aseguradoras se ocupa de cada cosa en los casos de lluvias o inundaciones extraordinarias?
Como ya comentamos en un post anterior, el Consorcio de Compensación de Seguros se ocupa de los riesgos extraordinarios que vienen recogidos en el Real Decreto 300/2004.
Cosas que paga el Consorcio de Compensación de Seguros
El CCS cubre los daños producidos por inundación extraordinaria, que es «el anegamiento del terreno producido por la acción directa de las aguas de lluvia, las procedentes de deshielo o las de los lagos que tengan salida natural, de los ríos o rías o de cursos naturales de agua en superficie, cuando éstos se desbordan de sus cauces normales, así como los embates de mar en las costas. No se entenderá por tal la producida por aguas procedentes de presas, canales, alcantarillas, colectores y otros cauces subterráneos, construidos por el hombre, al reventarse, romperse o averiarse por hechos que no correspondan a riesgos de carácter extraordinario amparados por el Consorcio de Compensación de Seguros, ni la lluvia caída directamente sobre el riesgo asegurado, o la recogida por su cubierta o azotea, su red de desagüe o sus patios».
Cosas que paga la aseguradora «normal»
Las aseguradoras «normales» cubren el resto de daños causados por el agua de lluvia que figuran en las cláusulas delimitativas de sus contratos.
Tipos de daños que cubre cada aseguradora
Siempre que tengas contratada una póliza de seguros de daños propios, lucro cesante o de vida y/o accidentes.
¿Qué pagaría el CCS?
- Seguros de comercios, viviendas, edificios, empresas: El Consorcio de Compensación de Seguros pagaría los daños materiales sobre los edificios, instalaciones, ajuar, maquinaria, mobiliario y mercaderías, etc. ya sea de empresas, comercios o viviendas, debido exclusivamente al agua que entró de la calle hacia el interior. Exclusivamente los daños del agua que iba por el suelo como un río y entró en nuestro edificio. También pagaría los daños en el edificio o mobiliario de bajos o garajes que debido al reflujo de agua por los inodoros, duchas, bañeras, labavos, sumideros, etc. Lo que no pagaría jamás el Consorcio de Compensación de Seguros son los daños causados por el agua que entra por cubiertas, lucernarios, patios de luces, ventanas, desagües de evacuación de aguas pluviales de techos, azoteas, etc. O sea, el agua que proviene de la parte de arriba del edificio no lo pagaría el Consorcio de Compensación de Seguros.
- En todos los seguros de vehículos a motor (coches, motos,…), aunque sólo estén a terceros: Los daños materiales de los vehículos que han quedado inundados por las riadas, garajes inundados, campas inundadas, etc.
- En seguros de pérdida de beneficios: El Consorcio de Compensación de Seguros pagaría la interrupción de la actividad o lucro cesante de ese negocio de acuerdo con el contrato de seguro siempre y cuando la interrupción de la actividad sea consecuencia de la inundación que proviene del suelo.
- Si una persona tiene una póliza de vida o accidentes: El Consorcio de Compensación de Seguros pagaría la indemnización de asistencia sanitaria, días de baja, secuelas, muerte etc., tal como indica el post sobre la valoración de personas lesionadas, siempre que la causa de las lesiones o muerte fuera debido al agua que iba por el suelo.
¿Qué pagaría el seguro ordinario?
En el caso que nos ocupa de lluvias torrenciales, la aseguradora normal pagaría, si es buena, el resto de daños causados por el agua, entendiendo por ello las cosas que se mojaron por la filtraciones de agua de lluvia, desbordamiento o saturación de canales de recogida de agua de la cubierta, canalones o tubos de evacuación de agua, etc. Pero atención porque depende de qué aseguradora tengas, es posible que no te cubran nada del tema de la lluvia.
¿Cómo valoran los daños y pérdidas?
Tanto el Consorcio de Compensación de Seguros como la aseguradora comercial, valorarían los daños materiales, corporales y las pérdidas (siniestro total, lesiones, existencias, pérdida de beneficios, etc.) del mismo modo que hemos indicado en los distintos posts de este Blog, pero la diferencia está en que el CCS utiliza el sistema de valoración de la garantía de incendio del contrato de seguro mientras que la aseguradora ordinaria utiliza la fórmula específica de la garantía de fenómenos atmosféricos, que acostumbra a ser bastante más restrictiva que la utilizada por el Consorcio de Compensación de Seguros. Podríamos decir que el CCS es más «generoso».
Reparación o reposición
Partiendo de que la cobertura de estos riesgos debe amparar los mismos bienes o personas y por la misma suma asegurada que la establecida para los otros riesgos previstos en la póliza de seguro ordinario, la indemnización a efectuar en su caso por el Consorcio de Compensación de Seguros comprenderá el importe de los gastos de reparación o reposición de lo dañado (en automóviles, el importe correspondiente al valor de mercado en el momento anterior al siniestro, si hay siniestro total), en función del importe que como suma asegurada figure en el seguro contratado. También se tendrán en cuenta los pactos de inclusión facultativa («valor de nuevo», «seguro a primer riesgo» o «con límite de indemnización», etc.), que en la póliza se hayan introducido.
Debe subrayarse que el Consorcio de Compensación de Seguros aplicará, en el supuesto de daños directos, la compensación de capitales dentro de una misma póliza entre los correspondientes a contenido y a continente.
Asimismo será de aplicación la regla proporcional en caso de infraseguro, si bien a estos efectos se tendrán en cuenta todos los capitales fijados para los bienes siniestrados, aunque lo estuvieran en distintas pólizas de las que deben llevar recargo del Consorcio de Compensación de Seguros.
Gastos complementarios
Se incluyen en la indemnización los gastos de desembarre, extracción de lodos, demolición, desescombro y transporte a vertedero o planta de residuos autorizados, con el límite conjunto del 4 por ciento de la suma asegurada. De estos gastos indemnizables se excluyen los de limpieza y desembarre de cauces públicos, canales, vasos de embalses o cunetas, dragados de fondos marinos; los de obras de drenaje de infraestructuras y los derivados de los honorarios de los profesionales designados por el asegurado para efectuar la peritación de los daños.
Pérdida de beneficios
Los términos de la cobertura en relación con la cuantificación e indemnización de la pérdida de beneficios serán los previstos en la póliza ordinaria.
La franquicia del Consorcio de Compensación de Seguros
En los seguros de personas no se efectuará deducción alguna por franquicia, mientras que en el seguro de daños en las cosas, y tratándose de daños directos, la franquicia a cargo del asegurado será de un 7 por 100 de la cuantía de los daños indemnizables. No obstante, esta franquicia no será de aplicación a los daños que afecten a vehículos asegurados por póliza de seguro de automóviles en cualquiera de sus modalidades (daños propios y, a partir de julio de 2016, también las que cubran solamente responsabilidad civil), a viviendas o a comunidades de propietarios de viviendas.
En el caso de la cobertura de pérdida de beneficios, la franquicia a cargo del asegurado será la misma prevista en la póliza, en tiempo o en cuantía, para daños consecuencia de siniestros ordinarios de pérdida de beneficios. De existir diversas franquicias para la cobertura de siniestros ordinarios de pérdida de beneficios, se aplicarán las previstas para la cobertura principal.
La franquicia se aplicará en cada siniestro y por cada situación de riesgo en que se hallen los bienes objeto de cobertura.
La cobertura de riesgos extraordinarios definida por la Ley tiene la consideración de protección obligatoria mínima, por lo que, si estos riesgos son cubiertos por una entidad aseguradora, se puede aplicar una franquicia menor, o no aplicar ninguna. Pero si, por no asumirse en la póliza privada, es el Consorcio de Compensación de Seguros quien se encarga de la cobertura, entonces tales franquicias serán aplicadas siempre. En este caso, la entidad aseguradora emisora de la póliza ordinaria puede, si lo desea, anular su efecto, haciéndose cargo sólo de la franquicia, sin que este hecho signifique que la entidad aseguradora privada esté cubriendo riesgos extraordinarios, ni que, por tanto, quepa excluir la actuación del Consorcio de Compensación de Seguros.
La Orden ECC/2845/2015 establece la franquicia a aplicar por el Consorcio de Compensación de Seguros en materia de seguro de riesgos extraordinarios.

Buenos días. Mi vehículo un Mercedes 320 CDI CLS se vio inundado por una lluvia torrencial y al primer taller que lo lleve me daban siniestro total. Me aconsejaron llevar a otro taller de un conocido. Este mecánico tubo el coche hasta en su casa para secarlo, cambiar tapicería, «arrancarlo» algo que nadie me aseguraba y después de mucho tiempo por presiones del perito se pago la factura (3.800 euroe) pero el coche apenas había salido a carretera. Una vez el consorcio liquidó parte de la factura 3600 euros porque el perito consideraba algunas piezas como fungibles, se estuvo probando durante un tiempo, y de vez en cuando se ponía en modo avería, se recorrieron 4123 km y llegó un momento que siempre se quedaba en 1ª marcha. Se llevó a la casa Mercedes y después de muchas averiguaciones descubrieron que unidad de regulación, provocaba fallos en la admisión de carburante y consecuentemente accionaba el funcionamiento en modo avería, y activaba la caja de cambios colocándolo en la primera marcha. La post-reparación costó 6600 euros y el consorcio dice que no se hace cargo porque «Para los vehículos particulares la garantía caducará a los tres meses o 2.000 kilómetros recorridos» y la casa Mercedes asegura que la avería es debida a la inundación. El valor Venal del coche en ese momento era de casi 10.000 euros.
¿Existe alguna posibilidad legal de ir contra el consorcio?, ya que contra el primer taller que me lo arregló no quiero ir porque hizo mas de lo normal .
Por lo menos reclamar la diferencia hasta el valor venal del coche. Ahora el coche esta funcionando perfectamente y no tiene ninguna pega. Y no hemos tenido que tirar un coche que nuevo vale más de 70.000 kms.

A finales de 2019 mi madre sufrió una inundación por el temporal de gota fría y el consorcio la indemnizó por los daños sufridos en la planta baja. El día 2 de septiembre pasado volvió s sufrir otra inundación debido a una tormenta muy fuerte y en la cual se declaró zona catastrófica. El perito del consorcio visitó la vivienda y realizó el informe con los daños apreciados. Esta misma semana recibe una llamada desde el consorcio diciéndole que si no presenta las facturas de reparación del anterior temporal (de hace tres años), no le van ha indemnizar.
Quisiera saber si esto es cierto ya que mi madre de 71 años desconoce donde están esas facturas y no sabe que hacer.

Lo mejor que usted puede hacer es plantear una reclamación al CCS con peritaje incluido. Si no, está perdida y no le pagarán nada o muy poco.

El artículo 18 de la LCS (Ley de Contrato de Seguro) dice que 40 días naturales desde que tú declaraste el siniestro al Consorcio de Compensación de Seguros.
Hola, mi padre fue víctima de las inundaciones extraordinaria del pasado septiembre del 2019 en la Zona de levante, que supuso la inundación completa de una casa de campo, con todos los daños materiales que eso supuso. La inundación superó los 2.20m y destrozó y daño, todo lo que contenía la misma.
Como es preceptivo, dimos parte a la compañía de seguros al día siguiente de dicha inundación y nos remitió con un documento al Consorcio, el parte se efectuó el 13/09/2019.
El perito del consorcio, vine a efectuar la peritación el 07/11/2019, pues bien, al día de hoy 10/03/2020 el perito no ha comunicado aún, la propuesta de peritación, a pesar de que comunicarme con su secretaria via e-mail, solo me han dado largas para informarme de la propuesta de peritación.
Puesto en contacto con el Consorcio, él mismo, solo se ha lavado las manos al respecto, amparándose en que ellos no puedan aprobar o denegar dicha peritación, por que aún no la han recibido del mismo.
Mi pregunta es, hay un plazo legal por el cuál ambos tienen que comunicar al afectado, el importe de dicha peritación ?

Quién tiene la obligación con usted es el Consorcio de Compensación de Seguros (CCS), no el perito. La Ley (artículo. 18 LCS) obliga al asegurador, en su caso el CCS, a pagar el importe íntegro del siniestro según las circunstancias conocidas antes de los 40 días desde que usted notificó el siniestro al asegurador.
El perito del CCS solo se debe al CCS, no a usted. Usted debe reclamar siempre al asegurador, que es quien tiene la obligación legal con usted. El perito de la aseguradora no tiene ninguna obligación legal con usted. La gente debe olvidarse de peritos, operarios o talleres de las aseguradoras. Debe reclamar al seguro, y el seguro no puede poner como excusa o pretexto de sus incumplimientos a peritos, talleres u operarios.

Me encuentro en una situación de i defensin total. Hace un mes llevé el coche al taller tras ponerme en contacto con el consorcio porque el coche se me había anegado con las inundaciones. Ese día se supone que lo ve el perito y del taller me dicen que lo recoja harta que se resuelva la decisión del perito. El lunes de esta semana me vuelven a llamar para que vuelva a llevar el coche porque vuelve el perito. Hoy viernes me dicen que vaya a recogerlo, el coche está arreglado. La factura son 499 euros, he de pagarla para poder retirar el coche. Estupefacta pregunto que còmo sè yo que lo que han hecho ( sin consultar conmigo, ni pedirme autorización, ni informarme de presupuesto alguno) me lo van a cubrir. Me dicen que han procedido a desmontar el coche y verificar que no hay daños porque así se lo ha indicado el perito. La factura obedece a seis horas de mano de obra, verificación de que no hay daños y limpieza de tapicería por valor de 100 euros (tapicería que sigue con el mismo olor y las mismas manchas). Inquieta vuelvo a casa y me pongo en contacto con el perito , el cual no se comunicó conmigo en ningún momento, más que para quedar el primer día conmigo. Me dice que él no ha dado permiso para ningún desmonte no verificación, que si los del taller lo han hecho ha sido por su cuenta y riesgo. Con lo cual, me quedo que una situación de indefensión total, habiendo pagado 500 euros que no sé si me cubrirán y de los que nadie me informó. Qué puedo hacer?
Lo que usted debe hacer es contratar y designar a un perito y que determine, junto con un taller de confianza, las circunstancias y consecuencias del siniestro de inundación, así como el alcance de los daños con su tasación económica. Si resulta que debe asumirlo el Consorcio de Compensación de Seguros (CCS), plantee usted una reclamación. Si el CCS está de acuerdo le indemnizará, y si no, deberán proceder al trámite pericial del artículo 38 de la Ley 50/1980. Una vez resuelto el trámite a su favor y resulta que el CCS no le paga, deberá acudir a los tribunales de justicia.

Por lo que está contando, al tratarse de una inundación (riesgo extraordinario), quien tiene la obligación de atender su reclamación es el Consorcio de Compensación de Seguros, no su aseguradora ordinaria. Por tanto no hace falta que destine esfuerzos reclamando a su aseguradora ordinaria porque será un sacrificio estéril.
Si ya ha dado parte de siniestros al Consorcio de Compensación de Seguros y aun no ha obtenido respuesta, puede acudir a una empresa de gestión de siniestros como ClaimCenter para que le asesoren de su caso particular o para que le tramiten el asunto. Piense que su seguro de vehículo incluye la garantía de defensa jurídica y reclamación de daños, que le pagará las facturas u honorarios, hasta el límite establecido, de los peritos, abogados y procuradores necesarios para obtener la indemnización del Consorcio. De este modo es muy probable que no deba gastarse nada.
