Al tiempo volvió a llover y volvieron a salir las goteras a la vecina. Como ya no me fiaba del seguro, llamé a la empresa que nos hace el mantenimiento de las bajantes por si podrían ayudarnos a averiguar el problema ya que suelen subir al tejado todos los años. Y acertamos porque el problema es que una bajante estaba atascada y el agua es estancaba arriba en el tejado hasta que provocaba goteras a la vecina. Seguido reclamo a la aseguradora que repare los daños de las goteras pero les paso la factura del albañil por esos trabajos que me exigieron y la factura por el desatasco. Me abonan el desatasco pero la factura del albañil dicen que no procede porque son trabajos propios de la comunidad que se deben hacer para el buen mantenimiento del tejado. Pero si el tejado estaba bastante bien y no era la razón, por qué se tiene que hacer cargo la comunidad de una mala valoración de los daños por parte de la aseguradora. Nosotros recomendamos siempre que nadie coja los operarios del seguro. No todos son malos, pero sí la inmensa mayoría. Piense que los operarios del seguro son los más baratos del mercado, no los mejores, y por tanto es posible que usted tenga los problemas que ha tenido si los coge. Si además esos operarios informan a la aseguradora de lo que han visto, no hacen más que liar el siniestro y luego vienen todas las reclamaciones y malentendidos. Y esto lo hacen cuando no les sale a cuenta la reparación por la cantidad fijada por el seguro. En ese instante mienten para sacarse el tema de encima. El seguro hace hacer de perito a los operarios cuando resulta que esos tienen un interés directo en la reparación. Puesto las reparaciones van a precio baremado, si la reparación les sale rentable la hacen y si no, se inventan cualquier pretexto para que el seguro lo interprete como siniestro no indemnizable como es su caso (falta de mantenimiento).
Lo que deberían hacer usted siempre es coger a sus operarios de confianza y pasar la factura al seguro o solicitar a un perito presencial desde el inicio. Sobre todo hacer fotografías para acreditar los hechos. O contraten ustedes a un perito. Pero huyan de los operarios del seguro como del Ébola o la Peste Bubónica.
Si su albañil sube cada año al tejado seguramente estará en buenas condiciones. Por lo que usted nos está diciendo, el accidente tenía su origen en la obturación del bajante, y si el operario del seguro no supo determinarlo es que era un auténtico inepto ya que existe mucha diferencia entre los vestigios de una filtración del tejado con la de una obturación de una tubería. No saber distinguir eso es de poca profesionalidad.
Sin ver los trabajos y conceptos facturados se nos hace difícil determinar si procede el pago de toda la factura del albañil de la comunidad, pero si el concepto es de localizar la obturación y el desatasco, en principio sería afirmativo pagarlo todo dependiendo del contrato.
