Los profesionales del seguro: Los talleres y las asistencias
En esta publicación hablamos sobre cómo actúan los talleres concertados del seguro y las asistencias subcontratadas para reparar averías y desperfectos en hogares o empresas. Sigue la linea de publicaciones que ya hemos hecho acerca de los profesionales del seguro, tales como Mediadores y Peritos.
Me dirigía por la autovía A-5 hacia Mérida, capital de Extremadura y antigua villa romana, cuando a la altura del punto kilométrico 335 un camión levantó una piedrecita de la calzada que impactó contra mi luna delantera causándole una fisura de unos 2 milímetros. Puesto tengo el vehículo asegurado a terceros con lunas, llamé a mi seguro quien me dijo que me dirigiera a una conocida empresa que reparan cristales ya que era un “taller concertado”. Paralelamente llamé a ClaimCenter y me informaron que lo más adecuado era que fuera a un taller de mi confianza y les exigiera que me cambiaran la luna delantera por otra original ya que está totalmente prohibido reparar las lunas delanteras. Obligatoriamente hay que cambiarlas todas. Les hice caso. Finalmente el seguro me pagó el cambio de la luna, tras enviar la factura.
¿Qué dice la Ley?
El art. 18 de la Ley 50/80 de Contrato de Seguro dice que el asegurador está obligado a satisfacer la indemnización al término de las investigaciones y peritaciones necesarias para establecer la existencia del siniestro y, en su caso, el importe de los daños que resulten del mismo. El segundo párrafo del mismo artículo también expone que cuando la naturaleza del seguro lo permita y el asegurado lo consienta, el asegurador podrá sustituir el pago de la indemnización por la reparación o la reposición del objeto siniestrado.
El art. 26 de la LCS dice que: el seguro, para la determinación del daño, se atenderá al valor del interés asegurado en el momento inmediatamente anterior a la realización del siniestro.
¿Cómo debe actuar el seguro en los casos de reparación directa?
La única condición es que el usuario consienta al seguro reparar en vez de indemnizar. De no ser así el seguro deberá pagar siempre.
¿Qué son los talleres mecánicos concertados?
Los “talleres mecánicos” son empresas cuya actividad es la de realizar trabajos de reparación y/o mantenimiento de automóviles, motocicletas, turismos, furgonetas, camiones u otros vehículos similares.
Los “talleres mecánicos concertados” son subcontratistas de las aseguradoras con quienes éstas han llegado a unos acuerdos. Estos pactos consisten en que el taller mecánico realizará unos descuentos en los materiales y mano de obra al seguro, además de someterse a las instrucciones que éste le dicte en cada momento a fin de economizar la reparación. A cambio, la compañía de seguros redirige los usuarios al “taller concertado” en el momento que éste declara el accidente. De este modo salen beneficiados los dos. El taller se garantiza un volumen alto de trabajo y la aseguradora se beneficia de los descuentos que le hace el taller. Más del 90% de la facturación de muchos talleres depende de su relación con las aseguradoras, por esta razón el “taller concertado” seguirá siempre las instrucciones que el seguro le indique.
El único beneficio que tiene el usuario de acudir al “taller concertado” es que no deberá avanzar el dinero ya que éste facturará directamente al seguro. De no ser “taller concertado”, el usuario deberá avanzar el dinero y recobrarlo con posterioridad a la aseguradora.
Tanto si el taller es concesionario oficial de una marca concreta como si no lo es, puede ser “taller concertado” de una compañía de seguros concreta. Son temas independientes.
Un concesionario oficial es un “taller mecánico normal” que representa una marca de vehículos concreta y se acoge a una serie de normas de la “marca”. A modo enunciativo, éstas puede ser que sólo puedan vender su marca de vehículos, sólo podrán utilizar piezas originales de la marca, etcétera. A cambio la marca le da a ese taller la exclusividad de venta de su marca de vehículos en la zona determinada, actuará como mayorista intermediario de piezas de recambio de la zona para otros talleres, etcétera.
¿Qué son las asistencias de las compañías?
Las “compañías de asistencia” son empresas que subcontratan a operarios a nivel local como son albañiles, pintores, carpinteros, electricistas, fontaneros, antenistas, parquetistas y otros industriales. Se desplazan hasta nuestros hogares o comercios para reparar averías y desperfectos derivados de siniestros como pueden ser fugas de agua, incendios, roturas de cristales u otros daños similares.
Las aseguradoras subcontratan las “empresas de asistencia”, cuyo ámbito de actuación es nacional, para que se ocupen de realizar las tareas de reparación con sus subcontratistas.
De modo análogo al de los “talleres concertados”, las “empresas reparadoras” ofrecen unos precios ajustados a los seguros para que éstos les encarguen un elevado volumen de trabajos. De este modo se benefician los dos: Las “empresas de asistencia” con una elevada frecuencia de trabajo y los seguros de unos precios muy bajos. Tal como hemos dicho anteriormente, la única ventaja para el usuario de aceptar la “asistencia” del seguro es que éste no deberá avanzar el dinero al operario para después “recobrarlo” al asegurador. Otra es la “comodidad” que le supondrá no tener que buscar operarios puesto el seguro se los envía directamente.
Y ¿los trabajos de taller o reparaciones del hogar se hacen correctamente?
La calidad de los talleres mecánicos
Cuando sufrimos daños en nuestro vehículo a consecuencia de un accidente y es la compañía de seguros quien debe pagar, lo único interesante para el usuario es saber si nos repararán bien el vehículo. Y eso pasa por saber si ese taller es fiable o de confianza. Las palabras “fiable” o “de confianza” no significan que sean simpáticos o nos ofrezcan un coche de substitución. Significan que, cueste lo que cueste la reparación, lo harán correctamente. Hacer lo correcto es utilizar materiales originales o, como dice la Ley, utilizar los mismos que antes de producirse el siniestro, además de que el mecánico haga su trabajo con rigor. Hacer lo correcto es utilizar como mínimo las calidades de materiales preexistentes y substituir todo aquello que deba ser substituido ya que en muchas ocasiones se reparan cosas irreparables resultando verdaderas chapuzas.
Hay que tomarse muy en serio las reparaciones ya que una mala ejecución de los trabajos puede afectar gravemente la seguridad y funcionalidad de nuestro vehículo, pudiendo conllevar accidentes de graves consecuencias personales para los ocupantes. En este sentido sabemos de lo que hablamos, puesto la actividad de ClaimCenter es tramitar decenas de miles de siniestros desde hace muchos años, y hemos visto multitud de casos desafortunados por culpa de trabajos mal ejecutados.
Los trabajos mal hechos tienen tres orígenes.
- Que el taller sea un tramposo, que significa que no hace lo que es debido y engaña al usuario por trabajos que no ha hecho o ha ejecutado mal, a conciencia, para enriquecerse de manera injusta a su costa.
- Que el taller sea un inepto, por lo que no sabrá resolver el problema por falta de conocimientos o pericia en la reparación.
- Que la aseguradora sea una tramposa, que significa que induce al taller a realizar reparaciones incorrectas con el único fin de enriquecerse injustamente a costa de los usuarios. En esta situación nos podemos encontrar con talleres honestos, que nos alerten del modo de actuar de la compañía de seguros, y nos pidan la diferencia de precio de hacerlo mal a hacerlo bien ya que el seguro es un timador, y como ellos no quieren perder dinero con la reparación, nos pidan la diferencia a nosotros. Esto último nos permitirá saber el tipo de seguro que tenemos contratado.
La calidad con las “empresas de asistencia” o “compañías reparadoras”
De manera análoga con los “talleres mecánicos concertados”, las aseguradoras utilizan las “empresas de asistencia” con el único objeto reducir sus costes.
Si contratamos a un cristalero para que nos cambie un cristal cuyo coste son 100 €, si hubiera sido el cristalero de la aseguradora quien hubiera cambiado el cristal, el seguro habría pagado 70 € en vez de 100 €. Pero como el cristalero del seguro es un subcontratista de la “compañía de asistencia”, éste cobrará 35 € porque su contratista se lleva el resto hasta los 70 €. Por tanto, ¿alguien cree que te harán un trabajo correcto por 35 € cuando su precio de mercado es de 100 €?
A diferencia de los talleres mecánicos donde los usuarios acudimos a arreglar el coche, el “reparador” debe desplazarse hasta el inmueble a realizar sus tareas de fontanería, pintura o lo que sea. Ello implica unos gastos de desplazamiento además de un tiempo perdido durante ese desplazamiento.
Las “marcas” de automoción estandarizan los tiempos necesarios para el despiece, montaje y cambio de componentes de los vehículos cuando deben repararse. Además, los proveedores de automoción suministran siempre al fabricante con las mismas piezas y con la misma calidad de materiales. A modo de ejemplo, está estandarizado que un mecánico debe cambiar un piloto delantero derecho de un SEAT Ibiza del año 1995 en 37 minutos, y viene definido qué tuercas y grapas se deben desmontar o substituir.
Cuando se trata de construcción de inmuebles no existe un único sistema constructivo sino multitud. Tampoco existe un procedimiento donde tengas el esquema perfecto de cómo hacer las cosas sino muchos. El proyecto de una obra varía sobre la marcha dependiendo de muchos factores. No existe ninguna obra que se termine exactamente como se había proyectado. Durante el transcurso de su ejecución todas sufren variaciones y desviaciones dependiendo de las circunstancias de cada momento. Por el contrario, antes de fabricar una motocicleta o un coche se sabe exactamente cómo y cuándo empieza y acaba.
Hay “empresas de asistencia” que en el sector de las reparaciones del hogar quieren desarrollar sistemas análogos al mundo de la automoción y es una tarea casi imposible debido a diversos aspectos. La inexistencia de procedimientos, especialización en determinados sistemas constructivos,…, lo hace una labor muy difícil, y para ello pondremos unos ejemplos. No es lo mismo “reventar” una pared de hormigón que una de cartón-yeso para buscar un tubo de agua. Si además no sabes por dónde tienes que hacerlo (por el piso superior, inferior o el del vecino) dificulta aún más la tarea. Tampoco es la misma situación encontrarte con una tubería de hierro muy maltrecha, que una de plomo, cobre, o polipropileno, dependiendo de la sección y de su estado de deterioro. Además, con demasiada frecuencia las instalaciones discurren por sitios inverosímiles. Todo esto lo describimos por un tema tan sencillo como reparar una fuga de agua, que es el tipo de accidente más común en los inmuebles.
Por estas razones, cuando un asunto es muy sencillo los reparadores de las aseguradoras lo solucionan sin mayor problema. Todo el mundo queda satisfecho. El usuario porque le han resuelto el problema y la aseguradora porque le ha supuesto un precio muy reducido. Pero los asuntos se complican cuando las labores son moderadamente o muy complicadas. En ese momento los “reparadores”, habiendo destrozado nuestra vivienda o sin ni siquiera intervenir, desaparecen y dejan “plantado” al usuario. Esto sucede porque el operario ve que en esa actuación no le saldrá a cuenta o deberá añadir dinero de su bolsillo ya que el seguro paga una cuota fija por esa tarea independientemente de lo que cueste, y por tanto no está dispuesto a realizar esos trabajos por lo que le pagan. Su solución es finalizar su actuación y marcharse dejando al usuario en la estacada. En ese momento empiezan los problemas del usuario con la aseguradora ya que operario no volverá. A nadie le gusta trabajar y además añadir dinero de su bolsillo.
Existen sistemas donde las aseguradoras pagan una “tarifa plana” a la “empresa de asistencia”, que podrían ser 350 € por todos los temas donde el importe de la reparación no supere los 2.000 €. Eso significa que si se trata de un tema donde el importe de la reparación son 1.237 €, la empresa de asistencia facturará al seguro 350 € a tarifa plana, y esa empresa deberá espabilarse para “apretar” a su subcontratista lo máximo posible para no perder dinero y obtenga un margen. De este modo bastantes aseguradoras subastan el precio medio de la reparación a la baja para que las empresas de asistencia oferten y el precio de cada caso sea lo más bajo posible.
Pues resulta que el fontanero del seguro que acude a nuestro hogar es un subcontratista de la “empresa de asistencia” que ha ofertado a su cliente por nuestra reparación un precio de 350 € sin tener ni idea con lo que se va a encontrar. Bajo esta operativa, cada uno puede pensar con qué se va encontrar cuando el seguro le recomiende sus operarios.
Las recomendaciones de ClaimCenter
En el caso de los talleres mecánicos: No hay que fiarse de las recomendaciones de las aseguradoras ya que son la opción más económica para ellas. Antes de escoger un taller debes consultar a otros usuarios, opiniones o foros de internet. Lo bueno de internet es que puedes obtener información muy fiable de casi todo (talleres, restaurantes, coches, bicicletas,…) en base a la experiencia de otros usuarios. Esto es lo que te dará mayor fiabilidad y saber si se trata de un “taller de confianza”.
En el caso de los reparadores: Jamás escoger los operarios de las aseguradoras. Debes pensar que no existen opiniones de operarios en internet por tratarse de pequeños autónomos. Tampoco se anuncian por ese canal. Si no sabes de ningún industrial de confianza, te recomendamos que acudas a ferreterías, almacenes de material de construcción, material eléctrico, pinturas, etcétera cerca de donde vivas. En esos establecimientos te darán los datos de uno o varios industriales fiables, vecinos de tu zona y buenos profesionales. El propietario del establecimiento no obtiene ningún beneficio del industrial y sabe que, si te falla con su recomendación, te perderá como cliente, pero si acierta te fidelizará. Sabemos que a la gente le da mucha pereza buscar por su cuenta y es mucho más cómodo escoger la opción que ofrece la aseguradora, pero es un tema de prudencia. No todos los operarios del seguro lo hacen mal. Hay algunos que lo hacen muy bien, pero es como jugar a la “ruleta rusa” con demasiadas balas en el tambor del revólver. Si el tema se tuerce, seguro que el usuario deberá acudir a la “ferretería” para solventar el tema y además deberá reparar su casa destrozada. Al final le supondrá 10 veces más trabajo y bastantes enfados.
Finalmente comentar que como todo en la vida, hay buenos y malos profesionales. Todos miramos por nuestro propio interés. Hay aseguradoras, talleres y reparadores que se ganan la vida trabajando correctamente, en cambio otros se la ganan timando a la gente. La cuestión es disponer de la información y herramientas necesarias para escoger a aquel que más nos convenga, si el buen operario o el timador.

El asunto que nos comentas se basa en las consultas que hicimos a las marcas automovilísticas a las que preguntamos, las cuales prohíben expresamente a sus concesiones la reparación de las lunas delanteras por no poder garantizar la seguridad del usuario del vehículo en caso de reparación ya que, concretamente la luna delantera, se trata de un elemento que afecta al campo de visión del conductor y además es un elemento de protección pasiva importantísimo para la seguridad interior de los ocupantes.
También quieren minimizar el riesgo de responsabilidad de cualquier incidencia debida a una mala reparación de la luna, donde como marca deben dar una garantía de reparación según lo que establece la Ley para la Defensa de Consumidores y Usuarios y donde además se les podría atribuir responsabilidades civiles de producto o post-trabajos, que les podría afectar al prestigio como marca además de indemnizaciones económicas a los perjudicados.
También nos hicieron mención del Reglamento nº 43 de la Comisión Económica para Europa de las Naciones Unidas (CEPE) – Disposiciones uniformes relativas a la homologación de los materiales de acristalamiento de seguridad y su montaje en los vehículos, que hace referencia a estos aspectos que estamos comentando.
