Siniestro de conductor no declarado en la póliza del vehículo
¿El seguro del vehículo cubre los daños causados a terceros cuando yo no estoy declarado en póliza?
Todos vehículos a motor (motocicleta, coche, furgoneta, camión,…) deben tener un seguro obligatorio del Automóvil (SOA), que cubra como mínimo la responsabilidad civil del conductor del vehículo culpable declarado en la póliza. Por ello, si un vehículo no dispone del SOA, la policía lo inmoviliza y deberás volver a casa andando, cargando con la correspondiente sanción.
Con el SOA, si tenemos un accidente de circulación y somos culpables, nuestra aseguradora deberá pagar todos los daños, pérdidas y otros conceptos a los inocentes, incluidos los ocupantes de nuestro vehículo. El único que no cobra es el conductor ni los daños al vehículo culpable.
Pero, ¿Cuándo el Seguro puede declinar el pago de indemnizaciones a los inocentes?
La respuesta está en tres supuestos, pero con matices.
- El primer supuesto donde la aseguradora del SOA no pagaría es si quien provoca el accidente es un ladrón que ha robado el coche. En cuyo caso será el Consorcio de Compensación de Seguros quien asumirá el pago de todos los daños causados.
- El segundo supuesto donde la aseguradora debería pagar siempre a los inocentes y luego podría recobrar (=reclamar las indemnizaciones pagadas a los inocentes) al conductor culpable y/o al propietario de ese vehículo, sería si el conductor hubiera conducido bajo les efectos del alcohol o drogas.
- El tercer supuesto, que ocurriría lo mismo del segundo, es si el conductor no tuviera carné de conducir.
Debemos puntualizar sobre el segundo y tercer supuestos, puesto hay jueces que estiman que el Seguro no puede recobrar al causante, ya que los seguros están para cuando la gente se equivoca, y por tanto, que dejen tranquilo al culpable ya que los seguros están para eso.
¿Y si mi padre no me declaró en la póliza?
Pero, ¿qué sucede cuando yo, ciudadano de 18 años con el carné de conducir y sin haber tomado ni una gota de alcohol ni drogas, me equivoco y soy culpable de un accidente de circulación con un vehículo perfectamente asegurado a terceros, pero que la póliza de seguros de ese vehículo declara en sus condiciones que están excluidos los daños causados por conductores menores de 25 años y/o con menos de dos años de carné o similar? ¿Voy o no voy con seguro?
En este caso tendremos que tener en cuenta una variable: si el propietario del vehículo que contrató el seguro devolvió firmado el contrato de seguro a la aseguradora. Resulta que la Ley (Art. 3 de la ley 50/80 de contrato de seguro) dice que el seguro sólo puede aplicar las cláusulas que limitan los derechos del asegurado si éste las ha aceptado específicamente por escrito. Por tanto, si la aseguradora no dispone de la copia del contrato de seguro firmado por el titular del seguro, no puede aplicar esa cláusula limitativa de derechos y debe pagarlo todo sin recobrar nada.
La última palabra la tiene el juez
En el caso que hubierais devuelto firmado el contrato del seguro, la última palabra la tiene el juez. En ocasiones, y dependiendo de las circunstancias, éste puede fallar en contra de la aseguradora, por entender que las circunstancias de aceptación de las cláusulas limitativas de derechos del asegurado no fueran del todo claras o se hubieran aceptado de una manera anómala.
También cabe la posibilidad que el juez diga que sí, que la aseguradora tiene derecho a recobrar al conductor y/o titular del vehículo, en cuyo caso deberíamos reintegrar el dinero pagado.
Puede parecer que los jueces hagan las cosas mal, pero todo lo contrario, habitualmente las hacen muy bien e interpretan la ley y las circunstancias en favor del más débil. Además de aplicar el derecho hacen justicia, e impartir justicia es su función y su servicio social más loable y destacable.
Conclusión
En los contratos del seguro existen cláusulas que limitan tus derechos, por lo que si no devuelves el contrato firmado no las estas aceptando. Puede que no estando declarado en la póliza y habiendo firmado las clausulas limitativas de derechos el juez falle a tu favor. Finalmente, tener claro que si el conductor cumple con el mismo perfil del contratante del seguro (edad y antigüedad de carné), la aseguradora no puede declinar ninguna reclamación.

Mi caso es el siguiente. Mi seguro es a terceros ampliado. Mi pareja tuvo un accidente con mi coche y no estaba declarada en póliza y tiene menos de dos años de carnet de conducir. 2. Infracción administrativa. Ir a más velocidad de la que tocaba. Te pueden sancionar por exceso de velocidad.
3. Responsabilidad penal. Puesto no cometiste ningún delito según nos contaste, no te sucederá nada.

Suponemos que tu seguro de coche incluye la garantía de DEFENSA JURIDICA Y RECLAMACIÓN DE DAÑOS que sirve para que tú puedas buscar ayuda de abogados y peritos, y las facturas de ésos los pague tu seguro del coche por esa garantía.

Mi sobrina acaba de sacarse el carnet AM y poner la como segunda conductora en un ciclomotor me sale por un ojo de ma cara.
Si hiciese un seguro a terceros en el que ella no conste en ningún lado y tubiese un accidente en el que el culpable es el otro vehiculo, entiendo que no tendria porque haber ningún problema.
Pero.. y si es ella la que tiene la culpa? Podrían reclamar me a mi el pago de la indemnización?

Los seguros de vehículos a motor tienen dos grandes partes: El Seguro de Responsabilidad Civil de suscripción Obligatoria (en España llamado SOA) que se adecúa a las Directivas de la Unión Europea, y por otra parte están el resto de garantías opcionales como son la “Asistencia en Carretera”, la “Responsabilidad Civil Voluntaria”, la “Defensa Jurídica y Reclamación de Daños”, etcétera.
El SOA (Seguro Obligatorio del Automóvil) es de obligado cumplimiento para la aseguradora que lo comercializa, y por tanto debe cubrir siempre los daños al perjudicado según las condiciones reguladas por la Ley (LRCSCVM – Ley sobre responsabilidad civil y seguro en la circulación de vehículos a motor).
Los únicos supuestos en los que la aseguradora puede repetir contra el conductor culpable, o el propietario del vehículo, son las reflejadas en el artículo 10 de la LRCSCVM
Por tanto, si una aseguradora quiere comercializar seguros de vehículos a motor, debe obligatoriamente cumplir con todos los supuestos de la LRCSCVM. Y si una aseguradora no quiere “jugar» a las normas del SOA, deberá abstenerse de comercializar seguros de vehículos a motor y deberá dedicarse a otra cosa. Por tanto, la Responsabilidad Civil Obligatoria la deberá pagar siempre el seguro y no podrá reclamar nada al conductor o al propietario del vehículo, independientemente de quien sea.
Otra cosa muy distinta son el resto de garantías (daños propios, lunas, accidentes del conductor culpable, etcétera) donde aquí sí que lo regula el contrato y la Ley (LCS y otras leyes complementarias).
Piense que un contrato de seguro NO REGULADO es un contrato privado donde las partes pactan una serie de supuestos tipos de accidentes, y por tanto, aquí sí que el seguro puede no cubrir ciertos tipos de daños propios o aplicar descuentos en las indemnizaciones por reglas de equidad por poner algunos ejemplos. Pero eso no sucede con el SOA que está perfectamente regulado.
En resumen: podríamos decir que esa persona no declarada puede conducir tranquilamente siempre con respecto a los daños que cause a terceros derivados de accidentes de tráfico, y puede tener problemas en el resto de supuestos, como por ejemplo el cobrar los daños propios del vehículo en caso de tenerlos asegurados.
Ahora bien, aunque todo esto sea cierto, le recomendamos que todo el mundo esté bien declarado para evitarse problemas.

Me acabo de sacar el carnet y mi pareja y yo queremos hacer un viaje. Él está asegurado en su coche, pero yo no estoy asegurada en ningún coche. Si tenéis la misma edad y la misma antigüedad del carné de conducir es indiferente quién sea el chófer ya que el riesgo viene dado por la edad y antigüedad de la licencia de conducción, no por el género (masculino o femenino) del conductor. Realizar distinción por género en un seguro podría interpretarse como algo ilegal y sancionable.
De no ser así deberíais declarar, al menos, aquél conductor cuyas circunstancias impliquen un mayor riesgo para no tener problemas en cuanto a aquellas garantías distintas al Seguro Obligatorio del Automóvil (SOA). El SOA ampara a cualquier conductor independientemente de sus circunstancias personales.

Tranquilo. La garantía de Responsabilidad Civil Obligatoria de su seguro debe hacerse cargo, y se hará cargo, de todos los daños y perjuicios que haya provocado a todos los perjudicados. Y esas indemnizaciones no pueden serle reclamadas a nadie a no ser que el conductor culpable fuera bajo los efectos del alcohol o drogas o alguno de los supuestos incluidos en el artículo 10 de la Ley 35/2015.
Respecto a si su aseguradora se hará cargo de los daños propios por la garantía de todo riesgo de daños propios, con o són franquícia, ya es otra cosa. Seguramente la aseguradora se negará a pagarle ya que no está declarado el póliza, pero ésta debería pagarle aplicando un descuento por una regla de equidad.
Y si eres inocente , te dan a ti por detras y no estaa uncluido en poliza. Que pasa si no estas incluido en poliza y tienes un accidente inocente?
Que la aseguradora del causante culpable lo debe pagar todo.

Aunque nos esté planteando un caso muy concreto, en caso de accidente puede haber múltiples soluciones dependiendo de no pocas circunstancias contractuales y legales. Obviamente desde alguna aseguradora le informarán que si su hijo no está incluido en el seguro del vehículo no quedan cubiertas una serie de garantías como las que nos está describiendo, pero no siempre es así. En muchas ocasiones, algunas coberturas quedan a decisión final de un juez, dependiendo de diversas variables.

Hay muchos puntos de vista e interpretaciones, y nosotros le indicamos el nuestro, que no es otro que sí debe cubrir los daños a terceros:
La cobertura de Responsabilidad Civil Obligatoria de un vehículo a motor viene regulada en la Ley 35/2015 y el Real Decreto 1507/2008. En dichas normas se establece cuál es la cobertura obligatoria y cuáles son las excepciones del Seguro Obligatorio del Automóvil (SOA).
Obviamente entendemos que no existe ninguna exclusión que sea la causa que usted nos está exponiendo, que no es otra que la declaración del conductor. Otra cosa distinta es cuando afecta a la cobertura de responsabilidad civil voluntaria y/o la de daños propios que, habiendo el tomador aceptado específicamente por escrito las cláusulas que limitan los derechos del asegurado, el juez entienda que no tiene cobertura o, teniéndola, es de aplicación una regla de equidad.
El otro día una chica me denunció por haberle pillado el pie con la rueda del coche, lo cual quiero aclarar que es mentira. Una vez recibida la denuncia fui a comisaria a dar mi declaracion y me comentaron que no tenia nada de lo que preocuparme porq lo arreglaria el seguro. Sí, lo paga el seguro dado el caso que sea responsable del accidente. De hecho el perjudicado tiene «acción directa» contra el asegurador, o sea, puede reclamar directamente al seguro obligatorio del automóvil de su vehículo.
Respecto al tema de si queda cubierta su responsabilidad civil en principio sí, a no ser el asegurador tenga aceptadas por escrito, por parte del tomador, las cláusulas que limitan los derechos del asegurado y/o el juez estime que el asegurador pueda recobrar al causante los daños provocados al tercero.

Sí, usted tiene toda la razón. Pero hay muchas aseguradoras que recobran alegalmente a sus asegurados, tomadores o conductores culpables, mediante acuerdos «extrajudiciales», los daños y perjuicios causados a terceros por este motivo, y la gente, desinformada y por miedo, pagan como pueden incluso vendiéndose la vivienda para hacer frente a la «deuda contraída». También intentan recobrar judicialmente a los usuarios estos asuntos, pese a saber lo que usted indica. Gracias por su comentario.

Si usted era el conductor del vehículo y usted fue el culpable del accidente, no tiene derecho a indemnización por sus lesiones, a no ser que el seguro tenga contratada la garantía de daños corporales al conductor, independientemente de quien sea el titular del seguro o del coche.
La garantía de daños corporales al conductor no tiene nada que ver con que el vehículo esté a terceros (SOA) o a todo riesgo. Es una garantía a parte totalmente independiente de las otras.

Sí, su Seguro Obligatorio del Automóvil de Responsabilidad Civil correrá con todos los gastos del accidente que su hijo haya causado a terceros. Está obligado a ello por Ley (Ley 35/2015).
Otra cosa muy distinta es si su seguro, una vez indemnizados a los perjudicados, le podrá repetir o reclamar a usted el importe íntegro que haya pagado a los perjudicados, ya que su hijo no está incluido en la póliza. Esto depende de lo siguiente:
Algunas compañías aseguradoras excluyen de la Responsabilidad Civil del Seguro Obligatorio del Automóvil los daños causados a terceros ocasionados por conductores menores de 25 años y/o con menos de 2 años de carné. Se trata de una cláusula que limita los derechos del asegurado, y para poder aplicarse, debe estar específicamente aceptada por escrito por el asegurado, o sea, usted (art. 3 Ley 50/1980). El tema clave está en si usted devolvió firmada la póliza y su contenido al asegurador. Si la aseguradora tiene el contrato de seguro firmado por usted donde acepta esa cláusula limitativa de derechos, la aseguradora le podrá recobrar los daños y muy posiblemente los deberá pagar. Si usted no firmó el contrato de seguro y por tanto no aceptó esa cláusula limitativa de derechos, el seguro jamás le podrá reclamar los daños, y en caso que lo haga judicialmente, la aseguradora perderá el pleito con toda seguridad.
